TERMS AND CONDITIONS FOR REGISTRATION AND PAYMENT AT OUR AUCTIONS AS OF JANUARY 1, 2009.

REGISTRATION: 

1. Photo ID will be required for registration. 

2. Bidder registration must be complete with full legal name, address, Phone number, ID number, Bank information and Signature.  No exceptions. 

3. We reserve the right to withhold registration to any person for any reason. 

4. Registration process may be video taped, photographed or otherwise recorded without further notice or notification to individual registrants.  

5. Registration for the auction grants the auction company or its representatives the right to verify registration information and credit worthiness via third party contacts.

6. Acceptance of the bidder card guarantees acceptance of terms as state here and on the bidder card.  

Timeliness of payment:  ALL purchases must be paid for at the end of each day's auction.  Merchandise may be removed by registered bidders during the auction prior to paying.  A signature will be required for release from the auction facility. 

Method of Payment:  Once registration is complete we will accept the following methods of payment: 

1.  Cash in US or Canadian Funds only. 

2. Checks drawn on a Montana bank or from banks in the states bordering Montana. 

3. Canadian cash will be accepted at the US/Canadian exchange rate posted at the auction, which will be the rate on the day prior to the auction.  In the event of significant change in the exchange rate at the time of deposit, Canadian buyers agree to make up any difference and auction company will refund any significant overage. 

4. Checks from Alberta and Saskatchewan, Canada which are tendered in US Funds. 

5. Cashier's checks from banks outside of Montana may be held or verified prior to release of the bidder's purchases at the auctioneers discretion.  This may necessitate waiting until the first business day following the auction.

6. No credit cards accepted.  No bank drafts, no wire transfers and no delay of payments.

7. This applies to the Great Falls Collector Car auction:

NO cars paid for in any out of state or Canadian funds will be released until Stan has personally approved the payment.  This may necessitate waiting until all cars are sold or until the major part of the auction is done. 
We reserve the right to hold any car until we are satisfied that the payment will clear our bank.  

8. Titles will be held for 15 days unless payment is made in cash day of auction.  

Please bear in mind that while Stan may know you personally, the cashiers probably do not. When you register you may be asked to show ID and fill out the bidder card completely even tho Stan would know you personally and perhaps not require that. The cashiers are required to get information and a signature or they are instructed not to issue a bidder card.  We appreciate your understanding.

PLEASE READ THE FOLLOWING STATEMENT.  IT IS PART OF THE LEGAL AGREEMENT YOU AGREE TO BY ACCEPTING A BIDDER CARD AND PLACING A BID AT OUR AUCTIONS. 

WHILE INFORMATION IS OBTAINED FROM SOURCES DEEMED RELIABLE, AUCTIONEERS AND/OR AUCTION COMPANY MAKE AND WILL MAKE NO REPRESENTATION OR GUARANTEE OF CONDITION OF ANY ITEM SOLD. ANY GUARANTEES OR STATEMENTS OF GUARANTEE ARE BETWEEN SELLER AND BUYER.  POTENTIAL BUYERS SHOULD AVAIL THEMSELVES OF THE OPPORTUNITY FOR PERSONAL INSPECTION AND BID ON ITEMS BASED ON THEIR EVALUATION OF CONDITION. ALL ITEMS SELL AS IS-WHERE IS WITH COST OF REMOVAL AND/OR STORAGE THE RESPONSIBILITY OF THE PURCHASER.  

OWNERSHIP OF ANY ITEM PASSES AT THE FALL OF THE HAMMER AND RESPONSIBILITY FOR PROTECTION OF BUYER'S PURCHASES BEGINS IMMEDIATELY.  

FURTHER TERMS AND CONDITIONS ARE STATED ON THE REGISTRATION CARD AND ARE PART OF THE AGREEMENT ACCEPTED BY THE REGISTRANT WHEN REGISTERING AS A POTENTIAL BUYER AT THE AUCTION.  STATEMENTS OR POSTINGS DAY OF AUCTION BECOME PART OF THAT AGREEMENT.  THIS PUBLIC STATEMENT AND THE ACCEPTING OF THE REGISTRANT CARD PLACES THE AUCTION COMPANY IN COMPLIANCE WITH USC 227 AND MONTANA AUCTION LAW.
